Terms of Service

1. Acceptance of Terms

By accessing or using the ToolCenter service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. ToolCenter reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

ToolCenter provides a suite of developer APIs including, but not limited to, screenshot capture, PDF generation, QR code creation, OG image generation, metadata extraction, image watermarking, image compression, and HTML-to-image rendering. The Service is provided as a cloud-based API accessible via HTTPS.

3. Account Registration

To use the Service, you must create an account by providing a valid email address and other required information. You are responsible for:

• Maintaining the confidentiality of your API keys and account credentials.
• All activity that occurs under your account.
• Notifying ToolCenter immediately of any unauthorized use of your account.

You must be at least 16 years old to create an account. You may not create multiple free accounts to circumvent usage limits.

4. API Usage Rules & Rate Limits

Each subscription plan includes a monthly API call allowance. Usage is tracked per calendar month and resets automatically. You agree to:

• Respect the rate limits associated with your plan.
• Not attempt to bypass rate limiting mechanisms.
• Not share your API key with third parties or expose it in client-side code.
• Use the API in a manner consistent with fair use — no excessive polling, no automated abuse.

ToolCenter reserves the right to throttle or suspend accounts that exhibit abnormal or abusive usage patterns, even within stated limits.

5. Prohibited Use

You may not use the Service to:

• Scrape, capture, or archive illegal, harmful, or infringing content.
• Conduct or facilitate distributed denial of service (DDoS) attacks.
• Capture content that violates the intellectual property rights of third parties.
• Generate screenshots or PDFs of websites for phishing, fraud, or impersonation.
• Distribute malware, spyware, or any malicious software.
• Access websites or services in violation of their terms of service.
• Store or process content involving child exploitation or abuse.
• Engage in any activity that violates applicable laws or regulations.

Violation of these rules will result in immediate account termination without refund.

6. Payment Terms

Paid plans are billed monthly in advance via our payment processor (Stripe). All prices are in Euros (EUR) and exclude applicable taxes unless stated otherwise. You agree that:

• Payment is due at the beginning of each billing cycle.
• Failed payments may result in service suspension after a grace period.
• ToolCenter does not store your payment card details — these are handled securely by Stripe.
• Prices may change with 30 days\' notice. Existing subscriptions will be honoured until the end of the current billing period.

7. Refund Policy

If you are unsatisfied with the Service, you may request a pro-rata refund within the first 7 days of a new paid subscription or upgrade. Refund requests must be submitted to [email protected]. After 7 days, no refunds will be issued for the current billing period. Downgrading to a free plan is always available.

8. Service Availability

ToolCenter targets 99.9% uptime for paid plans. However, no SLA guarantee is provided for the free tier. We reserve the right to perform scheduled maintenance with reasonable advance notice. ToolCenter shall not be liable for any downtime, data loss, or service interruptions caused by:

• Force majeure events (natural disasters, pandemics, etc.).
• Third-party service failures (hosting providers, DNS, etc.).
• Scheduled or emergency maintenance.
• Your own misuse or misconfiguration.

9. Data Retention

Screenshots, PDFs, and other generated content are cached temporarily based on your plan's cache duration (1h–72h) and then automatically deleted. We do not inspect, analyse, or retain the content of your generated files beyond the cache period. API usage logs and metadata are retained for up to 90 days for analytics and debugging purposes. Account data is retained until you delete your account.

10. Termination

You may cancel your account at any time from the dashboard or by contacting support. ToolCenter may terminate or suspend your account at any time for violation of these Terms, with or without notice. Upon termination:

• Access to the API will be revoked immediately.
• Cached content will be deleted within 24 hours.
• No refund is provided for termination due to Terms violation.

11. Intellectual Property

The ToolCenter, its documentation, branding, and all related software are the intellectual property of ToolCenter. You retain ownership of any content you generate using the API. You grant ToolCenter no rights over your content. ToolCenter grants you a limited, non-exclusive, revocable licence to use the API in accordance with these Terms.

12. Limitation of Liability

To the maximum extent permitted by applicable law, ToolCenter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service. ToolCenter's total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid to ToolCenter in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless ToolCenter from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the European Union and the applicable member state where ToolCenter operates. Any disputes shall be resolved in the competent courts of that jurisdiction.
